Privacy Policy
[Company Name] ("we," "us," or "our") · App: [App Name] · Effective date: [Date] · Last updated: [Date]
Drafting note: this is a starting template, not legal advice. Fill in every [bracketed] item and have a licensed attorney review it before you publish, especially because the app sends automated text messages and email, which are heavily regulated.
1. Introduction
[App Name] is a software platform that helps service businesses manage leads, quotes, scheduling, jobs, invoicing, and customer communication, including automated follow-up messages about leads and appointments. This Privacy Policy explains what information we collect, how we use and share it, and the choices you have.
This policy applies to our website, mobile and web applications, and related services (together, the "Services"). By using the Services, you agree to the practices described here.
2. Two Types of People Whose Data We Handle
It helps to understand our role up front:
Customers are the businesses and individuals who sign up for [App Name] and use it to run their business ("Customers" or "Account Holders"), along with their team members ("Users").
End Contacts are the clients, leads, and prospects of our Customers, such as a homeowner who requests a quote from a landscaping company that uses [App Name].
For information about Customers and Users, we act as the business / controller. For information about End Contacts that a Customer uploads or collects through the Services, we act as a service provider / processor on behalf of that Customer, and the Customer's own privacy policy governs how they use that data. If you are an End Contact and have a question about your data, please contact the business that messaged you first. We will also help you directly (see Section 10).
3. Information We Collect
3.1 Information you provide to us
Account information: name, email address, phone number, business name, business address, password, and role.
Billing information: payment card or bank details (processed by our payment provider; we do not store full card numbers), billing address, and subscription history.
Customer Content: information you enter or upload, including client names, phone numbers, email addresses, service addresses, job notes, photos, quotes, invoices, appointment details, and message templates.
Communications with us: support requests, feedback, and survey responses.
3.2 Information we collect automatically
Device and usage data: IP address, browser type, device identifiers, operating system, app version, pages or screens viewed, features used, and timestamps.
Cookies and similar technologies: used for sign-in, security, preferences, and analytics (see Section 8).
Location data: if you enable location features (for example, job routing or arrival notifications), we collect approximate or precise location from your device. You can disable this in your device settings.
3.3 Information about messaging activity
When the Services send or receive messages for a Customer, we collect and store message content, recipient phone number or email address, delivery status, timestamps, replies, opt-in and opt-out records, and consent history. We keep consent and opt-out records so that Customers and we can demonstrate compliance with messaging laws.
3.4 Information from third parties
We may receive information from integrations you connect (such as calendar, accounting, payment, or CRM tools), from lead sources you authorize, and from service providers that help us verify accounts or prevent fraud.
4. How We Use Information
We use information to:
Provide, operate, maintain, and improve the Services;
Send automated and scheduled messages (text, email, and in-app) on a Customer's behalf, at that Customer's direction;
Process payments and manage subscriptions;
Provide customer support and respond to requests;
Send service announcements, security alerts, and (where permitted) marketing about our own Services;
Detect, prevent, and investigate fraud, abuse, spam, and security incidents;
Enforce our Terms of Service and comply with legal obligations;
Analyze usage to develop new features; and
Create aggregated or de-identified data that cannot reasonably identify any person, which we may use for any lawful purpose.
We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
5. Automated Messaging (Text and Email)
A core feature of [App Name] is helping Customers automatically follow up with leads and clients. This section explains how that works.
Customer responsibility. Each Customer decides who receives messages and what the messages say. Customers are responsible for obtaining any legally required consent before messaging an End Contact and for honoring opt-outs.
Text messages. Where required, messages are sent only to people who have given consent or who have an established business relationship with the Customer, as allowed by law. Message frequency varies based on the Customer's settings. Message and data rates may apply.
Opting out. End Contacts can reply STOP to any text message to stop receiving texts from that sender, and HELP for assistance. Email messages include an unsubscribe link. We process opt-outs promptly and suppress further messages to that number or address.
Carrier information. Mobile opt-in data and consent are not shared with third parties or affiliates for their own marketing or promotional purposes.
Call and message records. We may retain records of messages, delivery, and consent for compliance and dispute-resolution purposes.
6. How We Share Information
We share information only as described below:
With Customers. End Contact data and message history belong to the Customer that collected it and are visible to that Customer and its authorized Users.
Service providers. Vendors who help us operate the Services, such as cloud hosting, SMS and email delivery providers, payment processors, analytics, customer support, and security tools. They may use data only to perform services for us.
Integrations you authorize. If you connect a third-party app, we share data with it as you direct.
Legal and safety. To comply with law, legal process, or government requests; to enforce our agreements; or to protect the rights, property, or safety of us, our users, or others.
Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to confidentiality protections.
With your consent or at your direction.
We do not sell personal information for money. We do not share personal information for cross-context behavioral advertising.
7. Data Retention
We keep information for as long as your account is active and as needed to provide the Services. After an account is closed, we delete or de-identify Customer Content within [90] days, except where we must retain it longer for legal, tax, security, fraud-prevention, or dispute-resolution reasons (for example, message consent and opt-out records, which we may keep for [5] years). Backups are overwritten on a rolling schedule.
8. Cookies and Analytics
We use cookies, local storage, and similar technologies to keep you signed in, remember preferences, secure the Services, and understand how features are used. You can control cookies through your browser settings, but some features may not work without them. Where required, we will ask for your consent to non-essential cookies. [If applicable: We honor Global Privacy Control and similar opt-out preference signals.]
9. Security
We use administrative, technical, and physical safeguards designed to protect information, including encryption in transit, access controls, and monitoring. No system is perfectly secure, so we cannot guarantee absolute security. If we learn of a breach affecting your information, we will notify you as required by law.
10. Your Privacy Choices and Rights
Depending on where you live, you may have the right to:
Know what personal information we collect, use, and disclose;
Access and receive a copy of your information;
Correct inaccurate information;
Delete your information;
Opt out of the sale or sharing of personal information or targeted advertising (we do not engage in these practices as described above);
Limit the use of sensitive personal information; and
Not be discriminated against for exercising your rights.
To make a request, email us at [privacy@yourcompany.com]. We may need to verify your identity. If you are an End Contact, we may refer your request to the Customer that holds your data, since they control it. You may appeal a denied request by replying to our response. Residents of some states may also contact their state attorney general.
You can opt out of our own marketing emails using the unsubscribe link, and you can manage cookies and location settings as described above.
11. Children's Privacy
The Services are intended for businesses and adults and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
12. International Users
The Services are operated from the United States and are intended for use in the United States [and Canada]. If you access them from elsewhere, your information will be transferred to and processed in the United States, which may have different data protection laws than your country. [If you will serve EU/UK users, add a section covering legal bases for processing, standard contractual clauses, and a representative, and consult counsel.]
13. Third-Party Links
The Services may link to third-party sites or integrations. We are not responsible for their privacy practices, and we encourage you to review their policies.
14. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or in the app before they take effect. The "Last updated" date above shows when this policy was most recently revised.
